Civil Case - First Amendment. County ordinance making it
unlawful for sell, rent, or make available graphically violent
video gams to minors or permitting the free play of graphically
violent video games by minors with a parent's consent is a
regulation of speech based on content and does not survive
strict scrutiny. The deleterious effect on psychological health
of minors playing violent video games is not supported in the
record. County constitutionally may not limit First Amendment
rights as a means of aiding parental authority. Case is remanded
for entry of injunction.
