Giving of a business judgment instruction in First Amendment retaliation claim was not error; exclusion of testimony district court found would be cumulative was not an abuse of its discretion; district court did not abuse its discretion in permitting defendants to file a motion to dismiss after the scheduling deadline as the basis for the motion only became evident after the deadline had passed.
