U.S. Court of Appeals Case No: 02-3073
Eastern District of Missouri
Civil case - civil rights. Giving of a business judgment instruction
in First Amendment retaliation claim was not error; exclusion
of testimony district court found would be cumulative was not
an abuse of its discretion; district court did not abuse its
discretion in permitting defendants to file a motion to dismiss
after the scheduling deadline as the basis for the motion only
became evident after the deadline had passed.
