Civil Case - breach of contract and misappropriation. On retrial for damages, district court did not err in denying motion for judgment as a matter of law on damages due to misappropriation as evidence from expert and other documentary evidence supported jury verdict. District court did not err in denying motion for new trial, as the substantial evidence supported verdict, and jury instructions fairly and adequately submitted the issues to the jury and errors were cured by curative instructions. Award of prejudgment interest on value of present loss was proper even if the damages were not readily ascertainable. District court's denial of exemplary damages and attorneys fees was not error or an abuse of discretion. [PUBLISHED]
