U.S. Court of Appeals Case No: 02-3273
Eastern District of Missouri
Civil case - civil rights. There was no genuine issue of material fact
as to whether employer failed to act in good faith to reasonably
accommodate plaintiff's disability, and the district court did not err
in granting the employer's motion for summary judgment; employer's
stated reasons for plaintiff's discharge - job abandonment and
insubordination - were not pretexts for discrimination based on
her disability, nor did plaintiff establish disparate treatment for
similarly situated co-workers; plaintiff failed to exhaust
administrative remedies with respect to her retaliation claim.
