023332P.pdf 07/30/2004 Charles I. Covey v. USA
U.S. Court of Appeals Case No: 02-3332
Western District of Missouri
Prisoner case - habeas. In case involving a claim that lawyer's advice
concerning an illegal money laundering transaction created a conflict of
interest and prevented him from asserting an advice-of-counsel defense at
trial, Covey failed to show that the alleged conflict of interest adversely
affected the lawyer's performance at trial, as all of the evidence in the
case showed that defendant knew he was making an illegal loan and
reliance on counsel's advice in making the transaction would not have
been objectively reasonable; consequently, counsel's alleged conflict of
interest could not have affected his decision as to whether to present the
defense and could not serve as the basis for an ineffective assistance of
counsel claim.
