U.S. Court of Appeals Case No: 02-3559
Eastern District of Missouri
Civil case - ERISA. Heschenberger trilogy of cases did not preclude
defendant from making clockwise offsets (reducing plan benefits
by the amount of worker's compensation received); plan administrators
did not abuse their discretion in determining that worker's
compensation benefits were of the same general character as benefits
provided under the plans; district court erred in finding defendant
may include in the offset the amount plaintiff paid in attorneys fees
and costs to obtain non-plan benefits.
