U.S. Court of Appeals Case No: 02-3804
District of Minnesota
Civil case - civil rights. Under the Minnesota Human Rights Act,
employer could not have discriminated against plaintiff based on her
breathing problems as it had no knowledge of the condition; failure to
accommodate claim must also fail, as employer had no knowledge of
the condition, and plaintiff's cancer, which had been treated
successfully, was not a disability under the Act.
