Civil Case - diversity. District court's grant of preliminary
injunction to enforce license agreement and enjoin licensee
from calling a pharmacy anything other than Medicine Shoppe
is affirmed. Because substantially all of the assets of the old
pharmacy were transferred, district court did not err in holding
Medicine Shoppe showed a probability of success on the merits,
Medicine Shoppe established a threat of irreparable harm, and
the balance of harm favored Medicine Shoppe.
