U.S. Court of Appeals Case No: 02-3902
District of Minnesota
Civil case - Civil rights. In this suit under the Americans
with Disabilities Act, plaintiff failed to establish a genuine
issue of material fact as to whether her employer failed to
accommodate her by not giving her a transfer to a different
department; plaintiff did not show that with the
accommodations employer had provided she was unable
to perform the duties of her position because of her
depression; plaintiff also failed to show that verbal
reprimand and denial of transfer amounted to an adverse
action for purposes of the Act.
