U.S. Court of Appeals Case No: 02-3923
and No: 02-3924
and No: 03-1343
Eastern District of Missouri
Civil Case - civil rights. In claim against state and county officials for
prolonged incarceration after prisoner was ordered released, district
court's denial of qualified immunity to five of the state defendants is
affirmed and reversed as to one defendant, as continued detention
constituted a deprivation of liberty interest, fact question was presented
whether defendants were deliberately indifferent, and constitutional right
was clearly established. Court declines to exercise jurisdiction over
decision granting qualified immunity to other defendants. [PUBLISHED]
