023967P.pdf 08/14/2003 Mark Whitehead v. David Dormire
U.S. Court of Appeals Case No: 02-3967
   Eastern District of Missouri
Prisoner case - habeas. Evidence was more than sufficient to support the state courts' findings that Whitehead acted with the purpose of causing serious injury as required for a second degree murder conviction; claim that counsel was ineffective in failing to call a forensic consultant to buttress his version of the shooting rejected, as the record from an evidentiary hearing showed the expert's proposed testimony would not have supported Whitehead's theory and may have actually supported the state's.
