024073P.pdf 12/31/2003 Maria Flores v. John Ashcroft
U.S. Court of Appeals Case No: 02-4073
   Agency
Petition for review - Immigration. As a decision to reinstate a prior removal order is actually the enforcement of a prior final order, the court of appeals has exclusive jurisdiction to review the removal decision, and petitioner's attempt to challenge the decision by way of habeas was incorrect; due process challenge to automatic reinstatement of prior removal order would not be reached since petitioner was statutorily ineligible for relief whether or not she had been granted a hearing; with respect to adjustment-of-status claim, petitioner was barred from receiving such relief.
