U.S. Court of Appeals Case No: 02-4105
Eastern District of Missouri
Civil case - Employment law. District court did not err in finding
supervisor's comment were not direct evidence of race discrimination, as
they were race-neutral comments about job performance; applying the
McDonnell Douglas analysis to plaintiff's indirect evidence of race
discrimination, plaintiff failed to make a prima facie case that his
termination was race-related, and, in any event, he failed to show the
stated reason for his discharge - refusal to obey a legitimate order - was a
pretext for race discrimination.
