U.S. Court of Appeals Case No: 02-4106
and No: 03-1007
Western District of Missouri
Civil case - Employment law. Evidence was sufficient to show parties
entered into a binding oral contract concerning commissions for an
account; jury's damage award was supported by sufficient evidence;
district court did not err in instructing the jury concerning aggregating
damages for separate violations of the contract; district court erred in
reversing jury's finding that employer's refusal to pay commissions was a
wilful act under Kansas law. (PUBLISHED)
