031126P.pdf 01/26/2004 United States v. Kenneth White
U.S. Court of Appeals Case No: 03-1126
   Eastern District of Missouri
Criminal case - criminal law. Incorrect date on the face of the search warrant did not render it invalid for lack of probable cause, as date was a clerical error. District court did not abuse its discretion in admitting evidence of drug possession in prosecution of felon in possession of a firearm, as drug possession was relevant. Misidentification of type of firearm in jury instruction did not deprive defendant of a fair trial, as specific type of firearm possessed is not an essential element of the offense charged.
