U.S. Court of Appeals Case No: 03-1128
District of Nebraska
Criminal Case - suppression. Denial of motion to suppress was
proper, as initial detention for traffic violation was proper and
conflicting information gave officer reason to expand the scope of the
stop; defendant's consent to search the van was voluntary and district
court's findings were not clearly erroneous; and officers did not
exceed the scope of the search--once dogs alerted to false ceiling,
officers had probably cause to search the false ceiling.
