031162P.pdf 11/21/2003 United States v. Junior Menteer
U.S. Court of Appeals Case No: 03-1162
Western District of Missouri
Criminal case - criminal law. Defendant's consent to search purged any
Fourth Amendment violation that may have occurred as a result of an
unreasonably long detention following the initial traffic stop; 1972
conviction for second-degree burglary in Missouri qualified as a violent
felony under the 18 U.S.C. Sec. 924(e); defendant's failure to object to
PSR's factual characterization of the burglary amounted to an admission
of fact which the district court could rely upon to determine that the
burglary qualified; federal firearm statute does not violate due process.
