U.S. Court of Appeals Case No: 03-1236
and No: 03-1244
and No: 03-1241
Eastern District of Missouri
Civil case - Bankruptcy. District court did not err in finding LIC failed
to prove a partnership interest entitling it to sue on behalf of the
Crossroads partnership, as the special master's finding that LIC was
never formally substituted as a limited partnership was supported by the
record, and LIC did not have standing to assert a derivative claim under
Missouri's Limited Partnership Law; district court did not err in
calculating the plaintiffs' damages for debtor's fraud and
misrepresentation; district court did not err in denying plaintiffs' claims
for punitive damages, as the record did not establish the required evil
motive; the court did err in granting prejudgment interest, as the
plaintiffs' claims were not liquidated or readily ascertainable; district
court did not err in finding debtor's fraud liability was not dischargeable
under Sec. 523(a)(2)(A); district court did not err in finding U.S. Bank
was not liable under Missouri Uniform Fiduciaries Law.
