Criminal Case - supervised release. Defendant was sentenced to 27 months imprisonment and 36 months supervised release; following revocation of his supervised release, defendant was sentenced to 12 months imprisonment and 36 months supervised release. United States v. St. John, 92 F.3d 761 (8th Cir. 1996) is overruled. The term of supervised release imposed upon revocation of supervised release may not exceed the statutorily authorized term, not just the term of supervised release initially imposed by the district court. The sentence imposed by the district court is affirmed. Criminal Case - revocation of supervised release. In reliance on United States v. St. John, additional term of supervised release following revocation is capped at the length of the original supervised-release term and thus case is remanded with instructions to reduce revocation sentence.
