U.S. Court of Appeals Case No: 03-1400
   District of Minnesota
[PUBLISHED] [Bye, Author, with John R. Gibson and Bowman, Circuit Judges]
Civil case - Federal Farm Programs. United States Department of Agriculture's decision to require Mages to repay $470,000 in farm program benefits reversed; the USDA erred in determining that Mages did not have a separate and distinct interest in his own farming operation as its determination is inconsistent with the applicable regulation; USDA also erred in finding Mages had engaged in a scheme or device to evade payment limitations under the farm benefits program.
