U.S. Court of Appeals Case No: 03-1545
Eastern District of Missouri
Civil case - Employment law. Plaintiff had no reasonable basis to
believe she was entitled to severance benefits when she offered her
resignation, and defendant's acceptance of the offer did not amount to
retaliation for assertion of ERISA rights; because she resigned, plaintiff
cannot establish she suffered an adverse emplyment action and cannot
raise discrimination claims under Title VII; change in position which
preceeded resignation was not an adverse employment action for Title VII
purposes.
