U.S. Court of Appeals Case No: 03-1604
Northern District of Iowa
Criminal case - Criminal law. Evidence was sufficient to support
conviction for drug conspiracy; evidence from prior drug deals was
admissible to demonstrate the existence and scope of the conspiracy and
defendant's participation in it; evidence that defendant had entered the
country illegally was admissible, as it explained his presence at the scene
of two searches and provided a motive for his flight; testimony on
meaning of certain terms was admissible as law enforcement officers can
testify as to the meaning of drug jargon; district court did not err in
allowing translated transcripts of foreign language recordings as evidence
for the jury's use, as defendant conceded the transcripts were accurate;
district court did not err in imposing an enhancement for leadership role;
discretionary refusal to grant a downward departure based on defendant's
mental capacity and lack of education was unreviewable.
