Civil case - Employment Discrimination. Plaintiff failed to show that
his Attention Deficit Disorder or depression substantially limited his
ability to learn to a considerable degree as compared to the average
person, and the district court did not err in granting the union summary
judgment on plaintiff's ADA claim; further, plaintiff failed to show the
union was ever aware that he had a learning disability, as there was no
medical evaluation finding such a disability at the time he was terminated
from the union's apprenticeship program; as the union was unaware that
plaintiff had a learning disability, it was not under any duty to offer
accommodation; record did not establish any connection between
plaintiff's requests for assistance and the decision to terminate him, and
his retaliation claim must fail. Judge Heaney, concurring.
