U.S. Court of Appeals Case No: 03-1691
   Eastern District of Arkansas
Civil case - diversity - breach of contract. District court's grant of summary judgment was proper in suit for specific performance of contract to sell radio station assets. Agreement was not amended and appellant breached contract by failing to apply for consent with FCC. Counterclaim was also properly dismissed as use of call letters did not exhibit ownership of letters and thus did not violate the agreement. [PUBLISHED] [Melloy, Author]
