Civil case - Consumer law. There was no evidence to support plaintiff's
claim that the defendant bank played any part in defendant Parker's
misrepresentations concerning the history and condition of a used car
Parker was selling or that Parker was acting within the scope of his
employment at the bank when he sold the car to plaintiff; district court
erred in refusing to submit the issue of punitive damages to the jury, as
there was sufficient evidence of outrageous conduct on Parker's part to
support submission of the issue under the Missouri Merchandising
Practices Act; case remanded for a trial on the issue of punitive damages.
