U.S. Court of Appeals Case No: 03-2307
   Northern District of Iowa
Civil Case - products liability. Under theory of res ipsa loquitur in a comparative negligence system, Iowa courts would hold plaintiff need not disprove their own fault in order to prevail. Argument that ladder manufacturer had complete defense under state-of-the-art defense to manufacturing defect claim precluded liability for general negligence claim was waived and no plain error exists in giving jury instruction. Judgment for injured person is affirmed. [PUBLISHED] [Melloy, Author, with Riley and Hansen, Circuit Judges]
