U.S. Court of Appeals Case No: 03-2321
Southern District of Iowa
Criminal case - criminal law. Probable cause is not required to perform
a Level II safety inspection on an over-the-road truck, and it was
permissible for the officer to open the compartment under the sleeper
mattress to try find the safety restraints; pre-Miranda statement was
admissible, as officer's question as to why defendant needed to make a
phone call was not calculated to elicit defendant's incriminating response
that he was going to go to jail; evidence was sufficient to support drug
and conspiracy conviction; district court did not err in applying a two-
level enhancement for obstruction of justice based on defendant's perjury.
