District of Minnesota
Civil case - ERISA. Plaintiff's retaliatory discharge claim was
completely preempted by ERISA, as the heart of her lawsuit was a claim
that defendant violated its ERISA plan by classifying her condition as a
sickness rather than an accident, and the district court did not err in
removing the suit to federal court; deferential standard would be applied
to plan administrator's decision on her claim, and the administrator's
decision to deny the claim was not an abuse of discretion; defendant was
not estopped from classifying plaintiff's injury as sickness because of
statements allegedly made by company employee and insurer's
representative concerning worker's compensation; under Minnesota law,
the award of worker's compensation benefits for plaintiff's condition
barred claims under the Minnesota Human Rights Act.
