032590P.pdf 01/04/2005 Randy Anderson v. United States
U.S. Court of Appeals Case No: 03-2590
District of Minnesota
Prisoner case - habeas. Counsel's failure to assert the argument that
Apprendi invalidated Anderson's guilty plea was not so egregious that it
deprived Anderson of his Sixth Amendment right to counsel; at the time
the case was briefed on appeal, no court had interpreted Apprendi's effect
on previously entered guilty pleas, and counsel's failure to anticipate the
issue did not render his performance constitutionally ineffective.
