U.S. Court of Appeals Case No: 03-2680
Northern District of Iowa
Civil case - employment discrimination. District court did not abuse its
discretion in denying employer's motion for judgment as a matter of law,
as plaintiff's evidence was sufficient to prove an objectively hostile work
environment, constructive discharge, notice of the harassment, failure
to remedy and retaliation affecting a material term or condition of
plaintiff's employment; plaintiff's evidence chronicled years of blatant
sexual harassment which was severe and pervasive enough to create an
objectively hostile work environment; district court did not abuse
its discretion in permitting plaintiff to amend her compliant after the
verdict to include a claim under the Iowa Civil Rights Act, as the
amendment was permissible under either Rule 15(b) or Rule 54(c);
award of $839,470 in compensatory damages, $33,314 in back pay and
$650,000 in punitive damages affirmed.
