Criminal Case - sentencing. On remand from United States Supreme
Court, sentence is reviewed in light of United States v. Booker. No Sixth
Amendment violation exists because district court did not make
prohibited findings. Defendant's sentence is reviewed for plain error and
none exists because there is no affirmative indication that sentencing
judge would have imposed a more lenient sentence if the judge had
understood guidelines to be advisory. Claims challenging whether verdict
was supported by substantial evidence are rejected for the reasons stated
in the prior opinion.
