U.S. Court of Appeals Case No: 03-2721
Western District of Arkansas
Civil case - Employment discrimination. Plaintiff's decision not to
appeal vice chancellor's decision regarding her tenure served as a
withdrawal from the tenure-review process; because plaintiff did not
pursue the additional levels of review available to her, she did not receive
an official denial of tenure and did not suffer an adverse employment
action for purposes of evaluating a retaliation claim under Title VII;
university established its affirmative defense to plaintiff's hostile work
environment claim, as it showed that it took action on the complaints it
received and that plaintiff failed to take advantage of the university's
grievance process.
