U.S. Court of Appeals Case No: 03-2763
District of Minnesota
Criminal Case - criminal law. Probable cause existed for defendant's
arrest, as defendant's behavior were reasonably suspicious to officers
trained to recognize behaviors of a lookout for drug deals. Statements
made to officers conditionally offered in exchange for a promise of
leniency were given willingly and voluntarily. Thus district court did not
err in denying motion to suppress. Delay in presentment was not
unreasonable and was not for purpose of investigating other crimes.
District court did not err in denying acceptance of responsibility
adjustment because defendant required government to prove its case at
trial. [PUBLISHED] [Smith, Author]
