U.S. Court of Appeals Case No: 03-2795
Eastern District of Missouri
Civil case - torts. In a case involving claims defendant failed to
adequately protect plaintiff from attack by an unknown third party,
district court did not err in finding that the prior criminal acts at the
store were insufficient to place defendant on notice that it was necessary to
protect its business invitees from attack by unknown third parties;
defendant's decision to provide security cameras and guards at the store
was not an admission that a foreseeable risk existed, because under
Missouri law, a defendant's decision to exercise greater prudence than the
law otherwise requires is not a basis for imposing a duty.
