U.S. Court of Appeals Case No: 03-2815
and No: 03-2816
Western District of Missouri
Civil case - Insurance. While insured psychologist's failure to report
child abuse to government officials was criminal conduct under Mo. Rev.
Stat. Sec. 210.115 and relieved the insurer of coverage under the
provision of a professional liability policy excluding criminal
misconduct, the provision did not preclude coverage on a claim that the
insured's failure to report breached a common law duty to the child's
caregivers to notify them that the child's father posed a future risk of
sexual abuse to her; case remanded for further proceedings on this claim.
