U.S. Court of Appeals Case No: 03-2824
Western District of Arkansas
[PUBLISHED] [Melloy, Author, with Hansen and Colloton, Circuit Judges]
Civil case - Civil rights. City ordinance forbidding flashing or blinking
signs was content-neutral on its face; the ordinance was constitutional
because it was narrowly tailored to serve a significant government
interest in assuring traffic safety and public esthetics and allowed ample
alternative channels for communication of plaintiff's messages. Judge
Colloton, concurring in the judgement. Judge Hansen, dissenting.
