Civil case - civil rights. District court erred in denying defendants'
motion to dismiss based on qualified immunity to plaintiff's claims
alleging he was constructively discharged in violation of his First
Amendment rights as a public employee; plaintiff resigned his position as
the result of a policy dispute and not because he had been punished for
exercising his public employee's First Amendment rights; governor's
decision to terminate plaintiff immediately after he announced his
resignation and stated he intended to make a public statement concerning
the dispute was not a violation of any constitutional right.
