U.S. Court of Appeals Case No: 03-2975
District of South Dakota
Civil case - Employment Discrimination. In a reverse discrimination
case, the plaintiff must show the background circumstances support the
suspicion that the defendant is that unusual employer who discriminates
against the majority; here, plaintiff failed to show the suspicious
circumstances necessary to establish his claim and the district court did
not err in granting GSA's motion for summary judgment; even if had
shown the suspicious circumstances, plaintiff failed to show GSA's stated
reasons for the decision to promote a female candidate - her superior
leadership skills and ability - was a pretext for reverse sex discrimination.
