Civil case - employment discrimination. While evidence concerning
harassment of which plaintiff was unaware was irrelevant to the issue of
whether plaintiff's work environment was actionable, the testimony was
properly admitted because evidence of the extent of the hostile
environment was probative on the matter of managerial motives and was
relevant to plaintiff's eligibility for punitive damages; evidence was
sufficient to create a jury issue on hostile work environment; district court
did not err in submitting punitive damages on both wrongful discharge
and harassment claims, as there was substantial evidence of egregious
racial discrimination at the plant, as well as intentional and malicious
conduct by the management; however, the punitive damage award on the
harassment claim is unconstitutional because it was based on evidence of
misconduct unrelated to plaintiff's claims, was far in excess of what
analagous statutes would permit and exceeded the ratio between
punitive and compensatory damages which the Supreme Court has
suggest is consistent with due process; due process requires the punitive
damages award on the harassment claim be remitted from $6.06 million
to $600,000.
