U.S. Court of Appeals Case No: 03-2980
District of Nebraska
Criminal Case - suppression. District court's denial of motion to
suppress is affirmed. Following a review of the video tape of the traffic
stop and request for consent to search the vehicle, a reasonable person
could have believed that defendant understood what the officer was
asking and gave permission to search. The district court did not clearly
err in concluding consent was not the result of duress or
coercion. [PUBLISHED] [M. Arnold, Author]
