U.S. Court of Appeals Case No: 03-3023
Western District of Missouri
Criminal case - criminal law. Defendant had a substantial property
interest in the van involved in a police stop and had standing to challenge
to search; however, on the merits, a brief stop of a loaned automobile
driven by a third party does not significantly impair the interests of the
person who lent the automobile; district court did not err in finding third
party validly consented to a search of the van; evidence was sufficient to
support drug convictions; acquittal of third party did not preclude
defendant's conviction on charge he conspired with and aided and abetted
the third party; no error in denying acceptance-of-responsibility reduction
where defendant pleaded not guilty and put the government to the burden
of proving his guilt.
