U.S. Court of Appeals Case No: 03-3058
Eastern District of Arkansas
Civil case - employment discrimination. Where an employer received a
complaint involving a single incident of supervisor sexual harassment,
and the employer was not previously on notice of the alleged harasser's
prior like-conduct or propensity to act, and the employer promptly
insulated the complainant from further harassment and promptly
investigated the allegations, the employer is entitled to judgment as a
matter of law on the complainant's sexual harassment claims. Dissent by
Judge Melloy.
