Civil case - employment discrimination. District court did not err in
granting employer's motion for judgment as a matter of law, as there was
no evidence, direct or circumstantial, to support the jury's findings that
the employer regarded plaintiff, who suffers from Marfan's Syndrome, as
having an impairment or that he was passed over for promotion because
of that perception. Judge Bye, concurring in part and dissenting in part.
