U.S. Court of Appeals Case No: 03-3084
Western District of Arkansas
Criminal case - criminal law. Search warrant was supported by
probable cause to believe weapons and explosives would be found in
defendant's residence; while some of the information contained in the
warrant application was improperly obtained based on questioning
conducted in violation of Miranda, the officers who obtained the warrant
had developed personal knowledge of the likely presence of the items
during a stand-off with defendant and his father and this was sufficient to
establish probable cause for the issuance of the warrant.
