Civil case - contracts. Settlement agreement gave defendant the
unilateral right to change the funding levels for settlement funds, and its
actions in changing the amount of budgeted reserves, thereby reducing
the amount of money available to pay customer refunds, were
permissible, and the district court erred in finding Heartland violated the
settlement agreement when it changed the levels.
