033177P.pdf 06/01/2004 Michael Negele v. John Ashcroft
U.S. Court of Appeals Case No: 03-3177
Agency
Petition for Review - Immigration. Former member of the Death's
Head unit of the Waffen SS who was responsible for policing the
perimeters at both the Sachsenhausen and Theresienstadt concentration
camps with an attack dog was subject to removal under the Holtzman
Amendment, 8 U.S.C. Sec. 1182(a)(3)(E)(i); the record in petitioner's
denaturalization proceedings was sufficient to establish that he had
assisted in Nazi persecution, and there is little doubt the prisoners
within the camps petitioner patrolled with his dog (trained to tear
to pieces anyone other than its trainer) would have considered him as
part of the Nazi machine which kept them at death's gate.
