U.S. Court of Appeals Case No: 03-3200
and No: 03-3201
Eastern District of Missouri
Criminal Case - sanctions. Appeal from orders imposing sanctions
against criminal defense attorneys are reversed. Rule prohibiting
communication with represented client without first obtaining permission
from client's existing counsel applies to attorneys involved in the matter
and does not apply to an attorney not so involved. District court abused
its discretion in imposing sanctions on attorney for issuing subpoena on
attorney to attend hearing, as findings of bad faith and vexatiousness were
not supported. [PUBLISHED] [Bye, Author, with Wollman, Circuit Judges]
