Civil case - civil rights. On claim that defendants had failed to take
adequate steps to prevent plaintiff's assault by a male patient at the
Fulton State Hospital Alcohol and Drug Abuse Rehabilitation Unit,
defendant Cox, a nurse on the unit, and defendant Houchins, a counselor,
were entitled to summary judgment based on qualified immunity, as their
actions and inactions were not so egregious and outrageous as to shock
the contemporary conscience; defendant Joy, the unit manager, was also
entitled to qualified immunity, as plaintiff failed to show Joy's
supervisory and training decisions represented a substantial departure
from accepted professional judgment, practice and standards; case
remanded with directions to grant the defendants' motion for summary
judgment.
