U.S. Court of Appeals Case No: 03-3335
Western District of Missouri
Civil Case - bankruptcy. BAP approved order for payment of
transaction fees of unsecured creditors committee from amounts
recovered by member of that committee; court of appeals has jurisdiction
because it is a final judgment as a result of subsequent approval of
reorganization plan. Dissolution of committee in reorganization plan did
not deprive committee of party status. Bankruptcy court did not abused its
discretion in ruling on manner for paying transaction fee. Sections 330
and 503 do not require administrative expenses be paid from any specific
funds of the debtor and bankruptcy court has properly exercised its
discretion. BAP order is affirmed. [PUBLISHED] [Chief Judge Loken,
Author, with Beam and Gruender, Circuit Judges]
