Criminal case - criminal law. District court erred in holding that
defendant's statement was the product of custodial interrogation
conducted without Miranda protections and had to be suppressed; looking
at the totality of the circumstances, court could not say defendant was in
custody when he was interviewed in his home, was told several times of
his right to terminate the interview at will, and was not subjected to the
types of restraints on freedom of movement associated with a formal
arrest. Dissent by Judge Morris S. Arnold.
